Affirmative Action and OFCCP Compliance

Helping Clients Meet Affirmative Action and OFCCP Compliance Requirements

The Office of Federal Contract Compliance Programs (OFCCP) monitors the affirmative action and non-discrimination practices of contractors and subcontractors who do business with the federal government.   As an agency within the U.S. Department of Labor, OFCCP is charged with enforcing a wide range of requirements governing hiring and other employment activities of federal contractors, including Executive Order 11246, Section 503 of the Rehabilitation Act of 1973 and the Vietnam Era Veterans’ Readjustment Assistance Act of 1974.

HMBR’s Labor and Employment Practice has substantial experience representing clients in matters involving affirmative action and federal contract compliance.  Our team has a comprehensive understanding of the laws and regulations governing contractors at the federal, state and local levels and helps clients take the right measures to meet their affirmative action obligations.  We regularly counsel companies operating across a broad range of sectors, including businesses in the construction industry which are subject to their own unique set of rules and standards.

Providing Proactive Counsel to Contractors and Subcontractors

At HMBR, we appreciate that the affirmative action requirements imposed upon government contractors and subcontractors can be extensive.  Our lawyers work proactively with our clients to ensure that they understand their obligations and take the right steps to document their compliance efforts.  Whether a client has longstanding contractual relationships with the government or is bidding to secure their first contract, we walk the client through each and every requirement, working to devise the strategies needed to meet their obligations.

Assisting Clients With OFCCP Audits

The attorneys in our Labor and Employment Practice are frequently called upon to represent contractors and subcontractors in connection with OFCCP audits and investigations.  When clients are targeted for OFCCP investigation, we carefully review their operations and procedures to deliver the documentation and support requested by the government.  In these situations, our goal is to make certain that our clients know how to appropriately respond at every point in the process so that the matter can be put to rest at the earliest possible stage.
