Defending Clients Facing Antitrust Claims and Government Investigations
The attorneys at HMBR defend clients in both private antitrust litigation and litigation brought by the U.S. Federal Trade Commission (FTC) and the Department of Justice (DOJ). We also represent clients facing antitrust investigations by the DOJ, the FTC and the various state departments authorized to conduct these types of government actions. HMBR lawyers have actively worked on antitrust matters for many years and our attorneys have prior, hands-on experience serving as federal prosecutors.

When litigation cannot be avoided, our lawyers have the trial experience needed to aggressively defend our clients in federal and state court and in antitrust arbitrations. We also provide targeted advice to clients on post-judgment remedies and enforcement, including divestitures.
The attorneys at HMBR are prepared to provide clients with the counsel and representation they need to successfully confront allegations of anticompetitive conduct, whether such allegations are in connection with a regulatory or criminal investigation or brought in court. Our recent experience includes:
- Defending a multi-hospital system and its affiliated physician network in a case involving allegations of price fixing. These charges were brought by a large national health plan which sought over $250 million in alleged antitrust damages and equitable relief. Following a full trial on the merits, the arbitration panel dismissed all claims against the hospital system and the physician network.
- Represented a multi-hospital system and its affiliated physician organizations in an anti-trust investigation conducted by the DOJ as a clinically integrated network and successfully resolved the investigation without any formal civil complaint being filed.
