HMBR Wins Summary Judgment for Local Teamsters Officers in Embezzlement and Breach of Fiduciary Duty Action
Hogan Marren attorneys successfully defeated breach of fiduciary duty claims brought against three former officers of a local Chicago teamsters union by a union member seeking disgorgement of the officers’ salaries totaling over $1.3 million. The local union member alleged the officers defrauded the members by concealing the poor financial condition of the Local while paying themselves excessive salaries and embezzling union assets. On March 27, 2019, United States District Court Judge Robert W. Gettleman granted summary judgment to the former officers, holding that the undisputed facts established there was no breach of fiduciary duty, no concealment of the Locals financial condition that the salaries were not excessive and there was no proof of embezzlement of the Local’s assets.
